The present invention relates to a phosphor and a light emitting device including the same. A phosphor according to an embodiment of the present invention has an empirical formula of R_1-xM_20-mL_10-nON_38-z : Q and emits emission spectrum of yellow. R includes at least one element among Ca, Mg, Sc, Gd and Lu. M includes at least one element among Si, Ge, C and Sn. L includes at least one element among B, Al, Ga and In. O is oxygen. N is nitrogen. An element of Q is a rare-earth element and includes at least one among Eu, Ce, Sm, Eu, Yb, Dy, Gd, Tm and Lu. x has a range of 0<=x<=0.2. y is 0
