PROBLEM TO BE SOLVED : To provide a fuel battery cell and a fuel battery with high catalytic activity of a fuel electrode and stable output density for long period, which can be operated in low temperature. SOLUTION : The fuel battery cell provided with an oxygen electrode at one side of a solid electrolyte and a fuel electrode at the other side thereof has an ion conductive and electron conductive intermediate layer 7 between the solid electrolyte and the oxygen electrode. The intermediate layer includes first particles 7a and second particles 7b including Ce and rare earth element Re (excluding Ce). The first particles 7a are composed of complex oxide particles of Ce having valence smaller than 4 and rare earth element (excluding Ce), and the second particles 7b are composed of complex oxide particles of tetravalent Ce and rare earth element (excluding Ce).
